Kinward Terms of Use

These terms apply when you download or use Kinward. In them, “we” and “us” mean Iosvisual, who makes Kinward — one independent developer.

Kinward is licensed to you under Apple’s Standard Licensed Application End User License Agreement (the “EULA”). These terms add to the EULA; if the two ever conflict, the EULA wins. If you don’t agree to them, please don’t use Kinward.

Kinward helps you keep memories, letters, recordings, guidance and documents for the people you love, and hand them on when you choose.

It is not a will, a trust or any other legal instrument, and nothing in it is legal, financial, tax or medical advice. Notes about property, money, accounts or your wishes have no legal effect on their own — for that, please speak to a qualified professional.

Kinward never delivers anything on its own. Sealed letters and capsules open only when you share them.

What you write, record and add belongs to you. We claim no rights over it, and we never receive it.

Because it’s kept only on your iPhone, you are responsible for backing it up. If your iPhone is lost or reset, or Kinward is deleted without a backup, we can’t recover what was in it.

Only add and share things you have the right to — photographs someone else took, for example, or other people’s private information — and please respect the privacy of the people you write about.

Kinward Plus is an optional, auto-renewing subscription that unlocks extra features — currently the book of your life, passing things on, the Clear look and additional app icons. Everything else in Kinward is free.

• Plans and prices are shown in the app before you buy. Payment is charged to your Apple Account when you confirm the purchase.
• Your subscription renews automatically at the end of each period (3 months or 1 year) unless you cancel at least 24 hours before the period ends. Your account is charged for the renewal within the 24 hours before the period ends.
• You can manage or cancel it in the iPhone’s Settings → your name → Subscriptions, or in Kinward → Settings → Manage subscription. Cancelling stops the next renewal; Plus stays on until the end of the period you’ve paid for.
• If a free trial is offered, any unused part of it ends when you buy a subscription.
• Payments are handled by Apple, and refunds are decided by Apple under its policies. You can ask for one at reportaproblem.apple.com.
• If a price changes, Apple will tell you beforehand as its rules require, and you can cancel before the new price applies.
• When Plus ends, its features switch off and Kinward returns to its standard look and icon. Nothing you’ve kept is removed.

Please don’t copy, modify, reverse-engineer or resell Kinward, interfere with how it works, or use it to break the law or anyone else’s rights.

Kinward’s name, design, writing, artwork and code belong to us and our licensors. The EULA gives you a licence to use the app; it doesn’t transfer ownership of it.

We work to keep Kinward running well, but we can’t promise it will always be available or free of errors. We may update, change or retire features. If we ever stop offering Kinward Plus, renewals will stop, and you won’t lose anything you’ve kept.

As far as the law allows, Kinward is provided “as is”, without warranties of any kind. Nothing in these terms takes away rights you have as a consumer that the law says can’t be taken away.

As far as the law allows, we aren’t liable for indirect or consequential losses, or for the loss of content kept only on your device. Our total liability to you for any claim is limited to what you paid for Kinward Plus in the 12 months before the claim. This doesn’t limit liability for death or personal injury caused by negligence, for fraud, or for anything else that can’t be limited by law.

You can stop using Kinward at any time by deleting it. Deleting the app doesn’t cancel a subscription — cancel it in your App Store settings. The EULA says when your licence to use Kinward ends.

We may update these terms. We’ll change the date at the top, and if a change is significant we’ll tell you in the app. Using Kinward after a change means you accept the new terms.

These terms are governed by the laws of Italy. This doesn’t take away any protection you have under the laws of the country where you live.
